The Affordable Care Act -better known as Obamacare- is once again headed to the United States Supreme Court; where the justices will decide whether the healthcare legislation violates the US Constitution.
“The law, commonly known as ObamaCare, was first upheld by the Supreme Court under the justification that by tying the individual mandate to a financial penalty it fell under Congress’ taxation power. When President Trump eliminated the penalty, Republican-led states claimed there was no longer a legal basis for the mandate,” reports Fox News.
The Fifth Circuit Court of Appeals decided last December that key aspects of the legislation violated the law by requiring individuals to purchase private health insurance or face a financial penalty.
“The individual mandate is unconstitutional because it can no longer be read as a tax, and there is no other constitutional provision that justifies this exercise of congressional power,” the ruling said.
The Court will likely rule on the case after the 2020 General Election.

BLUE STATE BLUES: New Jersey to REINSTATE OBAMACARE Tax as Prices SPIRAL
Just months after the Trump administration and the GOP-controlled Congress officially ended Obama’s individual mandate requiring all Americans to face a penalty if uninsured, New Jersey is poised to reinstate the tax as healthcare costs spiral out of control.
“Governor Phil Murphy on Wednesday signed the new tax into law that will impose the tax on residents who choose not to purchase ‘qualifying’ health insurance as defined by Obama-era regulations,” writes Americans for Tax Reform.
According to the organization, nearly 80% of New Jersey households impacted by the Obamacare mandate earn under $50,000, directly harming low-income workers throughout the state who are ineligible for other programs, such as Medicaid.
“78% of New Jersey households hit by the Obamacare mandate tax make less than $50,000 per year. According to the IRS, the Obamacare mandate tax hit 188,570 New Jersey families and individuals in the most recent year of available data. 146,910 of these taxpayers made less than $50,000 per year – 78 percent of those impacted by the mandate,” says the report.

“That’s the Texas lawsuit. We think it’ll be upheld, and we think it will do very well in the Supreme Court. And if the Supreme Court rules that Obamacare is out, we’ll have a plan that is far better than Obamacare,” he added.
