'ABUSE OF OUR LAWS': Ted Cruz Discusses Ending Birthright Citizenship [WATCH]

Texas Senator Ted Cruz stopped by Hannity Thursday night to dissect the debate on allowing those born in the United States to be citizens despite the citizenship status of their parents.

“So there are two big legal issues at stake in the Supreme Court case. One, which is a massive legal issue, is the permissibility of nationwide injunctions from individual district judges. We’re seeing this,” Cruz said. “This is the new iteration of lawfare where left-wing attorneys general are suing President Trump in front of radical judges and getting national injunctions. I am very hopeful the Supreme Court will make clear in this case that nationwide injunctions are being abused against the Trump administration and will rein it in.”

“If we get a ruling like that, that will be a huge, huge victory to stop the latest iteration of lawfare that’s being waged against the president. The second big issue is the substantive issue of birthright citizenship. As I said, on a policy matter, I think it’s a slam dunk that ending birthright citizenship makes sense,” Cruz added. “It’s common sense.”

Cruz said the legal debate centers on whether ending birthright citizenship requires a constitutional amendment or can be done through Congress. He added that regardless of the outcome on birthright citizenship, a ruling to limit nationwide injunctions would be a “major celebration” for the Trump administration.

“There is an open legal question, Sean, about the method to do so, and legal scholars disagree. Some legal scholars argue that the only way to end birthright citizenship is through a constitutional amendment. Others argue that Congress could do it through a statute. What President Trump is arguing is that he could do it through an executive order,” Cruz said.
