THROWN OUT: Judge Dismisses Comey, James Indictments — But Charges Could Be Brought Again

According to a Fox News report, federal Judge Cameron Currie found that Lindsey Halligan could not charge James Comey and Letitia James.

Halligan was ruled an invalid U.S. attorney.

Currie dismissed the false-statement charges against Comey and the bank-fraud charges against James without prejudice, meaning some charges could be brought again.

Both defendants had asked that the cases be thrown out with prejudice, preventing them from being reopened. However, the ruling by Currie comes after the five-year statute of limitations against Comey expired, meaning the case against him cannot be reopened.

Halligan’s office can seek a new indictment against James since the statute of limitations hasn’t run out in her case — rendering Monday’s ruling a “temporary procedural win,” former federal prosecutor Neama Rahmani told The New York Post.

“I am heartened by today’s victory and grateful for the prayers and support I have received from around the country,” said James, who faced up to 60 years in prison on charges of bank fraud and making false statements to a financial institution.

“I remain fearless in the face of these baseless charges as I continue fighting for New Yorkers every single day.”’

“I conclude that the Attorney General’s attempt to install Ms. Halligan as Interim U.S. Attorney for the Eastern District of Virginia was invalid and that Ms. Halligan has been unlawfully serving in that role since September 22, 2025,” Currie wrote.

The Department of Justice could appeal the decision or attempt to bring the charges under a different U.S. attorney. Fox News Digital has reached out to the DOJ for comment.
