According to a Fox News report, the U.S. Department of Justice released a sweeping internal report Tuesday alleging the Biden administration selectively enforced federal law against pro-life activists — raising fresh questions about fairness inside the nation’s top law enforcement agency.
The findings stem from a review of more than 700,000 internal records conducted by a “Weaponization Working Group,” a team established under Donald Trump to examine whether federal power had been used for political ends.
At the center of the report is the enforcement of the Freedom of Access to Clinic Entrances Act, commonly known as the FACE Act — legislation designed to protect access to abortion clinics as well as pregnancy resource centers.
Acting Attorney General Todd Blanche said the findings point to a troubling pattern.
“This department will not tolerate a two-tiered system of justice,” Blanche said. “No Department should conduct selective prosecution based on beliefs.”
The report alleges prosecutors coordinated with abortion-rights organizations — including Planned Parenthood, the National Abortion Federation, and the Feminist Majority Foundation — to gather information used in investigations targeting pro-life activists.
Investigators claim those partnerships helped track activists and shape prosecutorial decisions.
More serious allegations follow.
According to the report, some prosecutors withheld evidence requested by defense attorneys, potentially undermining defendants’ ability to mount a full legal defense.
In one cited instance, a DOJ official told defense counsel they did not maintain requested records — despite allegedly having the information “readily available,” according to the review.
The report also claims prosecutors sought to exclude jurors based on religious beliefs and pursued aggressive arrest tactics in certain cases.
One example highlighted is the prosecution of pro-life activist Mark Houck, where authorities declined a request for voluntary surrender and instead authorized an FBI arrest at his home.
Sentencing disparities are another flashpoint.
The review found prosecutors sought an average of 26.8 months in prison for pro-life defendants — more than double the 12.3 months sought in cases involving violence against pro-life organizations.
Officials behind the report argue the enforcement of the FACE Act was uneven, with a stronger focus on protecting abortion clinics while failing to adequately pursue attacks on churches and pregnancy resource centers.
The Biden-era Justice Department has not yet publicly responded to the report’s claims.
