COMMON SENSE IN THE COMMONWEALTH: VA Supreme Court Tosses Challenge to School Mask Opt-Out

A win for Governor Glenn Youngkin (R-VA) and his Administration.

Earlier this week, the Virginia Supreme Court tossed out a challenge to Youngkin’s Executive Order banning mask mandates in schools; Youngkin had issued the order on his first day in office, writing: 

A child whose parent has elected that he or she is not subject to a mask mandate should not be required to wear a mask under any policy implemented by a teacher, school, school district, the Department of Education, or any other state authority.

A group from Chesapeake, Virginia challenged the mandate —but it was thrown out by the Virginia Supreme Court. Virginia Attorney General Jason Miyares applauded the move, sharing the news on Twitter.

“The Supreme Court of Virginia has rejected a challenge out of Chesapeake to @GovernorVA‘s EO2. This is a win for Virginia families.”

Youngkin also tweeted about the victory:

“We are pleased by the dismissal. We will continue to protect the rights of parents to make decisions regarding their child’s health, education, upbringing, and care.”

“To be clear, this is not about pro-mask vs. anti-mask, but rather parents making decisions about what’s best for their child’s health,” the governor continued.
