Instead of addressing the issues down at the southern border, the Biden Administration is suing someone who is addressing the issues —Governor Greg Abbott. The Biden DOJ is after Abbott for his floating barrier in the Rio Grande that prevents illegal migrant crossings.
“The State of Texas’s actions violate federal law, raise humanitarian concerns, present serious risks to public safety and the environment, and may interfere with the federal government’s ability to carry out its official duties,” the DOJ said in a letter to Abbott, first reported by the Houston Chronicle.
“This floating barrier poses a risk to navigation, as well as public safety, in the Rio Grande River, and it presents humanitarian concerns,” the DOJ letter continued. “Thus, we intend to seek appropriate legal remedies, which may include seeking injunctive relief requiring the removal of obstructions or other structures in the Rio Grande River.”

A spokesperson for the Justice Department’s Environment and Natural Resources Division (ENRD) confirmed to Fox Digital that the DOJ “sent a letter to the Texas Governor and Attorney General providing notice of our intent to pursue legal action related to unlawful construction of a floating barrier in the Rio Grande River, pursuant to section 10 of the Rivers and Harbors Act, 33 U.S.C. § 403.”
Abbott announced the barrier, consisting of orange buoys and intended to discourage migrants from crossing the Rio Grande, in June and began installing it this month. It is part of Operation Lone Star, a multifaceted operation to tackle the border crisis amid what Republicans say is a lack of leadership from the federal government.
Abbott doesn’t seem concerned about the Biden Admin’s threat to get litigious.
“Texas has the sovereign authority to defend our border, under the U.S. Constitution and the Texas Constitution. We have sent the Biden Administration numerous letters detailing our authority, including the one I hand-delivered to President Biden earlier this year,” Abbott tweeted.
“The tragic humanitarian crisis on the border was created because of Biden’s refusal to secure the border. His open border policies encourage migrants to risk their lives crossing illegally through the Rio Grande, instead of safely and legally over a bridge.”
