Penny will be arrested on second-degree manslaughter charges.
A spokesperson for Manhattan District Attorney Alvin Bragg’s office has confirmed that commuter Daniel Penny will be charged in the death of homeless man Jordan Neely after putting him in a fatal chokehold last week.
“The 24-year-old former Marine is expected to be arraigned in Manhattan Criminal Court Friday in a case that has sparked local and national outrage including from New York officials who’ve called Penny a vigilant,” Politico reports
“We can confirm that Daniel Penny will be arrested on a charge of Manslaughter in the Second Degree,” a spokesperson for the Manhattan District Attorney’s Office said. “We cannot provide any additional information until he has been arraigned in Manhattan Criminal Court, which we expect to take place tomorrow.”
Penny’s lawyers say he acted in self-defense.
